{"id":267,"date":"2011-03-24T00:41:39","date_gmt":"2011-03-24T04:41:39","guid":{"rendered":"http:\/\/www.masspirates.org\/blog\/?p=267"},"modified":"2011-03-24T00:41:39","modified_gmt":"2011-03-24T04:41:39","slug":"coica-has-not-been-refiled-but-domain-seizures-continue","status":"publish","type":"post","link":"https:\/\/masspirates.org\/blog\/2011\/03\/24\/coica-has-not-been-refiled-but-domain-seizures-continue\/","title":{"rendered":"COICA has not been refiled, but domain seizures continue"},"content":{"rendered":"<p>The Combating Online Infringement and Counterfeits Act (COICA) has not been refiled yet, but the US government has continued seizing domain names.\u00a0 It began when the Immigration and Customs Enforcement (ICE), part of the Department of Homeland Security (DHS), seized 82 domain names last November, including a <a href=\"http:\/\/torrentfreak.com\/u-s-government-seizes-bittorrent-search-engine-domain-and-more-101126\/\" target=\"_blank\">BitTorrent search engine<\/a>, and four popular <a href=\"http:\/\/theurbandaily.com\/music\/pharoh-martin-2\/feds-sieze-and-shut-down-popular-hip-hop-music-websites\/\" target=\"_blank\">rap websites<\/a>: <a href=\"http:\/\/onsmash.com\" target=\"_blank\">onsmash.com<\/a>, <a href=\"http:\/\/rapgodfathers.com\" target=\"_blank\">rapgodfathers.com<\/a>,\u00a0 <a href=\"http:\/\/dajaz1.com\" target=\"_blank\">dajaz1.com<\/a> and <a href=\"http:\/\/rmx4u.com\/\" target=\"_blank\">RMX4U<\/a>.\u00a0 The seizure of domain names that merely link to &#8220;infringing content&#8221; is very troubling and could have implications for more mainline search engines such as Google or Bing.\u00a0 In the case of the rap web sites, they were blogs that artists and labels would <a href=\"http:\/\/www.techdirt.com\/articles\/20101130\/00245312049\/if-newly-seized-domains-were-purely-dedicated-to-infringement-why-was-kanye-west-using-one.shtml\" target=\"_blank\">often give recordings to<\/a> in an effort to build buzz for their music.\u00a0 The evidence cited by DHS has tended to be <a href=\"http:\/\/www.techdirt.com\/articles\/20101217\/01190512310\/homeland-security-presents-evidence-domain-seizures-proves-it-knows-little-about-internet---law.shtml\" target=\"_blank\">laughable<\/a> and even included <a href=\"http:\/\/www.techdirt.com\/articles\/20101222\/02112912376\/more-bigger-mistakes-discovered-homeland-securitys-domain-seizures.shtml\" target=\"_blank\">four songs that were given to one blog by the labels so that the blog would promote them<\/a>.<\/p>\n<p>The Department of Homeland Security (DHS) continued with a <a href=\"http:\/\/www.techdirt.com\/articles\/20110214\/16451913091\/homeland-security-seizes-another-18-domain-names-with-no-adversarial-hearings-due-process.shtml\" target=\"_blank\">Valentine&#8217;s day seizure<\/a> of sites accused of selling counterfeit goods.\u00a0 DHS also seized mooo.com on accusations of trafficking in child pornography and so <a href=\"http:\/\/torrentfreak.com\/u-s-government-shuts-down-84000-websites-by-mistake-110216\/\" target=\"_blank\">took down 84,000 websites<\/a>. Thankfully that domain was restored.<\/p>\n<p>While the domain names were seized with the approval of a judge, the owners of the domains seized were <a href=\"http:\/\/www.techdirt.com\/articles\/20110314\/01204913484\/more-reasons-why-homeland-security-seizing-domain-names-is-unconstitutional.shtml\" target=\"_blank\">denied their 5th amendment<\/a> <a href=\"http:\/\/www.techdirt.com\/articles\/20110215\/22214113120\/once-again-why-homeland-securitys-domain-name-seizures-are-almost-certainly-not-legal.shtml\" target=\"_blank\">due process rights<\/a> since they were never allowed to challenge the seizures before they occurred.
