{"id":7006,"date":"2020-12-23T13:00:00","date_gmt":"2020-12-23T18:00:00","guid":{"rendered":"https:\/\/masspirates.org\/blog\/?p=7006"},"modified":"2020-12-23T12:46:03","modified_gmt":"2020-12-23T17:46:03","slug":"legislature-fumbles-police-reform-bill","status":"publish","type":"post","link":"https:\/\/masspirates.org\/blog\/2020\/12\/23\/legislature-fumbles-police-reform-bill\/","title":{"rendered":"Legislature Fumbles Police Reform Bill"},"content":{"rendered":"\n<p>Governor Baker opposed the limited restrictions on facial recognition software in the legislature&#8217;s <a href=\"https:\/\/www.wbur.org\/news\/2020\/12\/01\/massachusetts-police-reform-legislation-explainer\">police <\/a><a rel=\"noreferrer noopener\" href=\"https:\/\/www.wbur.org\/news\/2020\/12\/01\/massachusetts-police-reform-legislation-explainer\" target=\"_blank\">reform<\/a><a href=\"https:\/\/www.wbur.org\/news\/2020\/12\/01\/massachusetts-police-reform-legislation-explainer\"> bill<\/a> (<a href=\"https:\/\/malegislature.gov\/Bills\/191\/S2963\">S.2963<\/a>). The legislature buckled and passed a bill that rolled back the <em>limited<\/em> restrictions the previous version had:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>It allows police to use court orders to request that the RMV, State Police, or FBI perform a facial recognition search. Court orders have a lower burden of proof than a search warrant;<\/li><li>Police won&#8217;t need to request a court order for a facial recognition search if they deem the request to be an emergency.<\/li><\/ol>\n\n\n\n<p>The bill requires police to report all facial recognition search requests to the state office of public safety, where residents may not be able to submit a FOIA request. It does require that the state office of public safety publish a yearly report with data on how many searches were performed, on behalf of which agencies, and in which types of investigations.<\/p>\n\n\n\n<p>The following features of the bill are in the final version based on reading the text, what I have heard from other activists and <a href=\"https:\/\/www.masslive.com\/politics\/2020\/12\/massachusetts-police-reform-bill-senate-redrafts-facial-recognition-proposal-after-gov-charlie-baker-rejects-restrictions.html\" target=\"_blank\" rel=\"noreferrer noopener\">reporting<\/a>:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>bans\u00a0chokeholds and restricts chemical weapons;<\/li><li>allows prosecutors to charge police who have sex with or indecently assault a person in custody;<\/li><li>forbids schools from disclosing certain student record information to law enforcement without student\/parent consent or a court order;<\/li><li>ends the requirement that police be stationed in schools;<\/li><li>restricts no-knock warrants.<\/li><\/ul>\n\n\n\n<p>While this bill will help limit police&#8217;s ability to harm citizens and starts the process of unraveling the school to prison pipeline, it doesn&#8217;t impose a facial recognition moratorium or do nearly enough to end racist policing.<\/p>\n\n\n\n<p>Ultimately, the only way we can ensure our rights are protected is to replace Democrats and Republicans with Pirates in the House and Senate. <a href=\"https:\/\/masspirates.org\/blog\/candidates-wanted\/\">We need you for 2022<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Governor Baker opposed the limited restrictions on facial recognition software in the legislature&#8217;s police reform bill (S.2963).
