[10:07pm] passstab: jokeefe, thanks [10:08pm] jokeefe: yr welcome [10:08pm] kit: I am familiar with the constitutional issues at the federal level and I have concerns about the proposed amendment [10:09pm] kit: You have to be really careful about this stuff, where you're changing fundamental elements of the bill of rights [10:09pm] kit: Eventually people came up with reasonable things, like the Sanders amendment [10:09pm] jokeefe: here is the proposed amendment if folks want to read it - http://passmassamendment.wikispaces.com/The+Language [10:09pm] kit: but if you just say "money is not free speech, the legislature can regulate it without constitutional safeguards" ... you have issues [10:10pm] kit: an extreme case being a law saying you can only donate to incumbents, or to the two major parties [10:10pm] kit: you need to build in content and viewpoint neutrality [10:10pm] jokeefe: very good point [10:11pm] kit: a similar (and actually harder) issue is what happens if you say "corporations have no constitutional rights" [10:11pm] kit: It would be totally reasonable to have a regime where that's true, and corporations have rights given to them by statute only [10:12pm] kit: but at present, we rely on the constitution for some corporate rights that are actually useful, like twitter's ability to challenge a subpoena for your information [10:12pm] kit: or the ACLU's ability not to have its files searched willy-nilly [10:13pm] kit: finally, as far as I know it's been the US Supreme Court applying the federal constitution to strike down anti-corruption laws, so I don't know that amending the Mass constitution would help [10:13pm] jokeefe: yes, since it was a Federal law clerk who made corps. people to begin with [10:14pm] jokeefe: <vastly simplifying> [10:14pm] srevilak left the chat room.
